Terms of Service

By accessing or using ColdWallets.ca you agree to be bound by these Terms of Service. If you do not agree, do not use the site.

Please read carefully

These Terms include a class-action waiver, a 6-month time limit on claims, a CAD $100 total liability cap, an indemnification obligation (you pay our legal fees if you sue and lose), and mandatory venue in Alberta small claims court. Read them carefully — by using the site you accept them.

1. Acceptance and modification

These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and Dan Carlson operating as ColdWallets.ca ("we", "us", "our", "the Site"). By accessing, browsing, or otherwise using any part of the Site, you agree to these Terms in full.

We may revise these Terms at any time by posting an updated version on this page and changing the effective date at the top. Your continued use of the Site after any change constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction to use this Site.

3. License to use the Site

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes, subject to these Terms.

You may not:

  • Reproduce, republish, resell, or redistribute Site content without our prior written consent, except as expressly permitted by the fair-dealing provisions of the Copyright Act (Canada) or equivalent law.
  • Scrape, crawl, or use automated means to extract Site content, except for search-engine indexing that respects our robots.txt file.
  • Reverse-engineer, decompile, or attempt to derive source code from the Site.
  • Interfere with or disrupt the Site's servers, networks, or security features.
  • Use the Site to violate any law or third-party right.
  • Impersonate any person or misrepresent your affiliation with any entity.

4. Intellectual property

All content on the Site — including articles, reviews, product data, images (except manufacturer product images used with permission or fair dealing), logos, and design — is owned by ColdWallets.ca or licensed to us and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

Third-party trademarks (Ledger, Trezor, Tangem, BitBox, NGRAVE, Coldcard, Coinkite, SafePal, Ellipal, Cypherock, Keystone, SecuX, BC Vault, CoolWallet, Amazon, Best Buy, Bitbuy, Newton, Coinsquare, Kraken, Ndax, Wealthsimple, and others) remain the property of their respective owners. Use of these names on the Site is for descriptive and comparative-review purposes only and does not imply endorsement, partnership, or affiliation unless expressly stated.

5. Product information, editorial content, and no-advice notice

All product reviews, comparisons, ratings, and buying guides on the Site reflect our independent editorial opinion. We do not accept payment in exchange for favourable coverage. However, we do earn affiliate commissions when readers purchase through our links (see our Affiliate Disclosure).

6. Third-party links and services

The Site links to manufacturer websites, cryptocurrency exchanges, and other third-party services. We do not operate, own, or control those services and are not responsible for their content, security, privacy practices, pricing, product quality, or availability. Your interactions with any third-party service are governed solely by that service's terms and privacy policy.

7. User submissions

If you submit content to us (via email, contact form, or otherwise), you grant ColdWallets.ca a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, and display that content in any medium. You warrant that you own or have the right to submit the content and that it does not violate any law or third-party right.

8. Warranty disclaimer

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT SITE CONTENT IS ACCURATE, COMPLETE, OR CURRENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLDWALLETS.CA AND ITS OWNER (DAN CARLSON), OPERATORS, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF CRYPTOCURRENCY, LOSS OF PROFITS, LOSS OF DATA, OR DEVICE DAMAGE — EVEN IF WE WERE ADVISED OF THE POSSIBILITY.

OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SITE IS LIMITED TO CAD $100. This limit applies to the total of ALL claims by you against ColdWallets.ca combined — not per claim.

10. Class-action waiver

You and ColdWallets.ca each agree that any dispute will be resolved in individual proceedings only. Neither party may bring a claim as a plaintiff or class member in any class, consolidated, mass-action, or representative proceeding. If a court finds this waiver unenforceable, the entire arbitration and limitation-of-liability section will terminate and the dispute must be brought in the venue set out below.

11. Time limit for claims

You must bring any claim arising from or related to these Terms or your use of the Site within six (6) months after the claim first accrues, or the claim is permanently barred. This contractual limitation period is shorter than the default statutory period and applies to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless ColdWallets.ca, its owner, operators, contractors, and agents from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising from (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any content you submit to us.

13. Termination

We may terminate or suspend your access to the Site at any time, with or without cause, and without notice. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, indemnification, and governing law — will survive.

14. Governing law and venue

These Terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

You agree that any dispute arising from these Terms or your use of the Site will be resolved exclusively in the Alberta Court of Justice (Civil Division), which handles claims up to CAD $100,000. You consent to the personal jurisdiction of that court and waive any objection based on inconvenient forum. Only if the amount actually in dispute exceeds that court's jurisdictional limit may the matter be escalated to the Court of King's Bench of Alberta. In all cases the venue is Alberta, Canada, and no other.

15. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, Disclaimer, and Affiliate Disclosure, constitute the entire agreement between you and ColdWallets.ca regarding your use of the Site.
